DMCA Policy

YAOYO, Inc. ("YAOYO") respects the intellectual property rights of others and expects users of yaoyo.tv (the "Service") to do the same. We respond to notices of alleged copyright infringement in accordance with the U.S. Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.

1. Submitting a Copyright Infringement Notice

If you believe content on the Service infringes your copyright, send a written notice to our Designated Agent containing all of the following:

  1. Identification of the copyrighted work you claim has been infringed (or a representative list if multiple works).
  2. Identification of the material claimed to be infringing, with information reasonably sufficient for us to locate it (e.g., the yaoyo.tv URL of the work).
  3. Your contact information: name, mailing address, telephone number, and email address.
  4. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.
  6. Your physical or electronic signature.

Please note that under 17 U.S.C. § 512(f), you may be liable for damages if you knowingly materially misrepresent that material is infringing.

2. Our Response

Upon receipt of a valid notice, we will remove or disable access to the identified material and make reasonable efforts to notify the user who posted it. The user may then submit a counter-notification.

3. Counter-Notification

If you believe your content was removed by mistake or misidentification, you may send a written counter-notification to the Designated Agent containing:

  1. Identification of the material that was removed and the location where it appeared before removal (e.g., the URL).
  2. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the U.S. federal district court for the judicial district in which your address is located (or, if outside the United States, the federal courts located in Delaware), and that you will accept service of process from the person who provided the original notice or their agent.
  4. Your physical or electronic signature.

If we receive a valid counter-notification, we will forward it to the original complainant. Unless the complainant notifies us within 10 business days that they have filed a court action seeking to restrain the allegedly infringing activity, we may restore the removed material within 10–14 business days.

4. Repeat Infringers

We will terminate, in appropriate circumstances, the accounts of users who are repeat infringers.
